Conditions of Use

1. General

All contractual relationships between users of this site (hereinafter referred to as ‘the customer’), and the site owner, The Urmston Musical Theatre and it’s trading name of www.umt.org.uk (both hereinafter referred to as UMT) are subject to the following terms and conditions. These shall form part of any contract between the customer and UMT. UMT reserve the right to amend these terms and conditions from time to time by updating this text page; and the customer is bound by any such modifications or revisions. Completion of an order request and payment are deemed conclusive evidence that the customer agrees to be bound by these terms. This does not affect the customer’s Statutory Rights as a consumer.

2. The Contract

The contract between UMT and the customer comes into existence when UMT accepts the customer’s order i.e. when payment has been received. UMT is entitled to reverse or withdraw from contracts in the case of obvious typographical or arithmetical inaccuracies appearing in the UMT on-line store. These terms and conditions shall be governed by and construed in accordance with the laws of England and any disputes arising will be decided only by the English courts. UMT makes no promise that tickets or the webpage indicating availability on the UMT site are available or accurate. If you choose to access this site from locations outside the United Kingdom, you do this on your own initiative and are responsible for compliance with local laws.

3. Pricing and Availability

The prices of goods are those specified in the UMT on-line store. The prices, as displayed, are inclusive of VAT (at the current standard UK rate). There may be an additional charge for delivery – please see separate section. Orders are subject to availability. Price and availability information is subject to change without notice. UMT will always endeavour to contact the customer should any product become unavailable and agree an adjustment to the customer’s order. If this is not possible, the order and total cost will be returned accordingly and the contract will then be deemed to have been fulfilled. UMT is entitled to deliver in part.

4. Loss in Transit

The responsibility of UMT for loss of goods in transit will be limited to – at the customer’s choice - replacing the products so lost or damaged or providing a refund no greater than the amount paid for those goods.

6. Intellectual Property

All the information, data, text, graphics, links or computer code published on, contained or available on this website (hereinafter referred to as the ‘Material’) are the copyright of UMT. Unauthorised use of the Material including the production, storage, modification, distribution or republication without the prior written consent of UMT or where applicable, the respective copyright owner(s) is prohibited. The names and logos of UMT and all related products and service names, design marks and slogans are the trade names, service marks or trade marks of UMT and may not be used without the prior written consent of UMT.

7. Disclaimer

UMT makes no warranty in respect of any products or service advertised on this website which is supplied by a supplier independent of UMT. UMT hereby, to the fullest extent permitted by law, disclaims all warranties and conditions with regard to the material and any goods and services supplied in relation to this website, whether expressed or implied or statutory (including all implied warranties and conditions of the merchant ability and fitness for a particular purpose). In no event that UMT be liable for any indirect, punitive, special, incidental or consequential damages whatsoever even if UMT has been advised of the possibility of damages including, without limitation, damages for loss of use, data or profits arising out of or in any way connected with the use or performance of this website, interruptions or delays to this website, the provision of or failing to provide services, or for any information, material, goods and services obtain through this website or otherwise arising out of the use of this website, whether based on contract, tort or otherwise to the fullest extent permitted by law.

8. Invalidity of Terms and Conditions

If for any reason part of these terms and conditions is deemed unenforceable, the validity of the remaining terms and conditions will not be affected.
